Terms of Service

Welcome to Baggyfy ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Baggyfy website located at baggyfy.in (the "Platform"), including all features, services, content, and functionality offered through the Platform.

By accessing or using our Platform in any way — including browsing, creating an account, saving products, or interacting with any feature — you agree to be legally bound by these Terms. These Terms constitute a legally binding agreement between you and Baggyfy.

Baggyfy is a free online wishlist and product organization platform designed for Indian online shoppers. Our Platform allows registered users to:

• Save product links from third-party e-commerce websites such as Amazon, Flipkart, Meesho, Myntra, Nykaa, and 50+ other stores.
• Create and manage custom folders to organize saved products by category, occasion, or any preference.
• Automatically fetch product titles, images, and store names from product URLs using our proprietary auto-fetch technology.
• Access saved wishlists from any device at any time.
• View curated product collections published by the Baggyfy team on the homepage.

Baggyfy is a wishlist and organization tool only. We do not sell products, process payments, manage inventory, or fulfill orders. All purchases are made directly on the respective third-party e-commerce platforms.

To use Baggyfy, you must meet the following eligibility requirements:

• You must be at least 13 years of age or older to create an account and use the Platform.
• If you are between 13 and 18 years of age, you must have permission from a parent or legal guardian to use the Platform.
• You must have a valid Google account to sign in, as Baggyfy uses Google Sign-In as its sole authentication method.
• You must not be prohibited from using our services under applicable laws in your jurisdiction.
• You must provide accurate information and comply with these Terms at all times.

Account Creation

Baggyfy uses Google Sign-In exclusively for account creation and authentication. By signing in with your Google account, you authorize Baggyfy to access your basic Google profile information (name, email address, and profile picture) solely for account identification purposes.

Account Responsibility

You are solely responsible for:

• All activity that occurs under your account.
• Maintaining the security of your Google account, which is used to access Baggyfy.
• Notifying us immediately at support@baggyfy.in if you suspect unauthorized access to your account.
• Ensuring that all information associated with your account remains accurate and current.

One Account Per User

Each user may maintain only one active Baggyfy account. Creating multiple accounts for the purpose of circumventing restrictions or policies is prohibited and may result in permanent suspension of all associated accounts.

You agree to use Baggyfy only for its intended purpose — saving, organizing, and managing personal product wishlists. Acceptable uses include:

• Saving product links from legitimate e-commerce websites for personal use.
• Creating folders and organizing products for personal shopping decisions.
• Accessing your wishlist across multiple personal devices.
• Using Baggyfy's auto-fetch feature to retrieve product information from publicly accessible product pages.
• Sharing your wishlist folders with friends or family for gift suggestions or recommendations.

You agree that you will NOT use Baggyfy to engage in any of the following activities:

• Violating any applicable local, national, or international law or regulation.
• Scraping, crawling, or using automated tools to access or collect data from the Platform in bulk.
• Attempting to gain unauthorized access to any part of the Platform, server, or database.
• Uploading or transmitting any viruses, malware, or any other harmful code.
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
• Using the Platform for any commercial purpose without our prior written consent.
• Interfering with or disrupting the integrity or performance of the Platform or its servers.
• Saving links to illegal, counterfeit, or prohibited products.
• Attempting to reverse engineer, decompile, or extract the source code of any part of the Platform.
• Circumventing, disabling, or interfering with security-related features of the Platform.
• Using Baggyfy to facilitate spam, phishing, or fraudulent activities of any kind.
• Creating accounts using false identities or providing misleading information.

What is User Content?

"User Content" refers to any information you submit, store, or transmit through the Platform, including product URLs, folder names, and any other data you input into Baggyfy.

Your Ownership

You retain full ownership of all User Content you submit to Baggyfy. We do not claim ownership of your personal wishlists, folder names, or any content you create.

License to Baggyfy

By submitting User Content to our Platform, you grant Baggyfy a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely for the purpose of providing the service to you. This license ends when you delete your content or terminate your account.

Your Responsibility

You are solely responsible for all User Content you submit. You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights, privacy rights, or applicable laws.

The Baggyfy Platform, including its design, layout, graphics, logos, icons, code, text, software, and all other content created by Baggyfy (collectively, "Baggyfy Content"), is the exclusive intellectual property of Baggyfy and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, personal, non-transferable, non-sublicensable license to:

• Access and use the Platform for personal, non-commercial purposes.
• View and interact with Baggyfy Content as intended by the Platform's features.

You are expressly prohibited from:

• Copying, reproducing, distributing, or creating derivative works of any Baggyfy Content.
• Using the Baggyfy name, logo, or branding without our prior written consent.
• Removing or altering any copyright, trademark, or proprietary notices from Baggyfy Content.
• Using any Baggyfy Content for commercial purposes without authorization.

Product Images and Titles

Product images, titles, and descriptions displayed on Baggyfy are fetched from third-party e-commerce websites and remain the intellectual property of their respective owners. Baggyfy does not claim ownership of any third-party product content.

Baggyfy allows users to save product links from third-party e-commerce websites including Amazon, Flipkart, Meesho, Myntra, Nykaa, and many others. These third-party platforms are entirely independent of Baggyfy and are governed by their own terms of service and privacy policies.

Baggyfy has no control over, and assumes no responsibility for:

• The content, accuracy, pricing, or availability of products on third-party platforms.
• The terms of sale, return policies, or customer service of any third-party store.
• Any transactions, disputes, or issues arising from purchases made on third-party platforms.
• Changes to third-party product pages, including product removal, price changes, or content updates.
• The privacy practices or data handling of third-party websites you visit through Baggyfy.

Baggyfy participates in affiliate marketing programs. This means that when you click on certain product links saved on Baggyfy and make a purchase, we may earn a small commission from the retailer at no additional cost to you.

Amazon Associates Program

Baggyfy is a participant in the Amazon Associates Program (India), an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.in and Amazon.com.

When Amazon product links are saved on Baggyfy, our affiliate tag (baggyfy-21) may be automatically added to the URL. This does not change the price you pay for any product — the commission is paid by Amazon to Baggyfy separately.

THE BAGGYFY PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Warranties that the Platform will be uninterrupted, error-free, or free of viruses or harmful components.
• Warranties regarding the accuracy, completeness, or reliability of any product information fetched from third-party websites.
• Warranties that product links saved on Baggyfy will remain valid or that products will remain available for purchase.

Auto-Fetch Accuracy

Baggyfy's auto-fetch feature retrieves product information (title, image, store name) from publicly accessible product pages. While we strive for accuracy, we do not guarantee that fetched information is always correct, up-to-date, or complete. Product details on third-party websites may change after they are saved to Baggyfy.

Service Availability

We do not guarantee that the Platform will be available at all times. We may experience downtime due to maintenance, technical issues, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by service unavailability.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BAGGYFY, ITS OWNERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
• Any loss of data, profits, revenue, goodwill, or other intangible losses.
• Any unauthorized access to or use of your account or personal data.
• Any bugs, viruses, or harmful code transmitted through the Platform by third parties.
• Any errors or omissions in product information fetched from third-party websites.
• Any issues arising from transactions made on third-party e-commerce platforms.
• Any loss or damage arising from reliance on any content displayed on the Platform.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations apply to the maximum extent permitted by law.

Termination by You

You may stop using Baggyfy at any time. If you wish to permanently delete your account and all associated data, please contact us at support@baggyfy.in with your registered email address and a request to delete your account. We will process your request within 30 days.

Termination by Baggyfy

Baggyfy reserves the right to suspend or permanently terminate your account at any time, with or without notice, for any of the following reasons:

• Violation of any provision of these Terms of Service.
• Engaging in any activity that harms the Platform, other users, or third parties.
• Providing false or misleading information during account creation.
• Extended periods of account inactivity (more than 24 months).
• Any other reason deemed necessary by Baggyfy to protect the integrity of the Platform.

Effect of Termination

Upon termination of your account, your right to access and use the Platform will immediately cease. All your saved folders and products will be permanently deleted. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — shall remain in effect.

Baggyfy reserves the right to modify, update, or replace these Terms of Service at any time at our sole discretion. We will notify users of significant changes through one or more of the following methods:

• Posting an updated version of these Terms on this page with a revised "Last Updated" date.
• Displaying a notification on the Platform the next time you log in.
• Sending an email notification to your registered email address for material changes.

Your continued use of Baggyfy after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform immediately.

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Jurisdiction

Any disputes arising from or relating to these Terms or your use of Baggyfy shall be subject to the exclusive jurisdiction of the courts located in India. By using our Platform, you consent to the personal jurisdiction of such courts and waive any objection to such jurisdiction.

Informal Resolution

Before initiating any formal legal proceedings, we encourage you to contact us directly at support@baggyfy.in to resolve any dispute informally. We are committed to addressing user concerns promptly and fairly.

Applicable Laws

Your use of Baggyfy is also subject to applicable Indian regulations including but not limited to the Information Technology Act, 2000, the Information Technology (Amendment) Act, 2008, and the Digital Personal Data Protection Act, 2023, as amended from time to time.
